PRIVACY POLICY

This Privacy Policy applies to personal information that Simple Equity Corp. (“Simple Equity”) collects through (i) our existing websites, www.simpleequity.ca and www.divorceassist.ca, (ii) any additional websites that we may launch, own, or operate in the future and that makes this Privacy Policy available to you (collectively, our “Websites”), or (iii) other interactions with our clients and prospective clients. In this Privacy Policy, the terms “we”, “our”, and “us” refer to Simple Equity.

 

We respect your privacy and take the protection and confidentiality of your personal information seriously. This Privacy Policy describes how we collect, use, disclose, and protect your personal information, and your rights in relation to that information. By using our Websites or submitting information through them, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy. We rely on express consent when required (e.g., for e-mail marketing) and implied consent when appropriate (e.g., for form submissions). You may withdraw your consent at any time by contacting us, subject to legal or contractual limitations.

 

This Privacy Policy is effective as of March 1st, 2025 (“Effective Date”). We may update it from time to time to reflect any changes to our practices, and when we do, we will revise the Effective Date. Your continued use of the Websites after a revised policy is posted constitutes your acceptance. We encourage you to refer back to this page periodically for the latest information about how we protect your privacy.

 

What Personal Information We Collect

Personal information is information that identifies you or could be combined by us or our service providers with other information to identify you. If you are a business customer or prospective business customer, personal information does not include your title, business address and business telephone number when we use that information to contact you in your business capacity.

 

We may collect personal information from you when you create an account, use our services, communicate with us using our web forms to make a request or ask a question, or when you otherwise submit personal information to us when communicating with us. The types of personal information that we may collect for these purposes includes your:

  • First and last name;

  • E-mail address;

  • Phone number;

  • Company or organization name;

  • Information or documents that you submit to a case file (e.g., marriage date, marital status, financial information, etc.); and

  • Login credentials and related account details.

 

Note that not all personal information that you provide through our Websites is normally accessible to us. For example, when you complete web forms to add personal information to a case file, that information is provided directly to our third party service providers for the purpose of creating a new user account and/or case file. By default, we cannot access that personal information, and access can only be granted by you – the case file owner – when you add another contributor and grant them the appropriate permissions. However, our third party service providers may be able to provide us with access to that personal information in exigent circumstances (e.g. in an emergency situation, or if required to comply with a court order), or when needed to provide us with technical support services.

 

We may also collect certain information automatically when you visit our Websites, such as information about your browser settings or your Internet Protocol (“IP”) address.

 

Unless otherwise specified in this Privacy Policy, we do not collect personal information from third parties unless you have explicitly permitted us to.

 

How We Use Your Personal Information

We use your information to provide our services to you, to communicate with you, to manage our business operations, and to comply with our legal obligations.

 

For example, we use your personal information to:

  • Verify your eligibility to use our services;

  • Register and manage your account;

  • Authenticate you when you log into your account;

  • Support your use of our platform, including case file management;

  • Analyze usage for security and performance improvements to our software and/or services; or

  • Respond to your inquiries and communicate with you.

 

We retain your information for as long as necessary to fulfill the purposes for which we collected the information unless a longer retention period is required or permitted by law. We will cease to3retain your personal information or remove the means by which the personal information can be associated with you as soon as it is reasonable to assume that such retention no longer serves the purpose for which the personal information was collected and is no longer necessary for legal or business purposes.

 

When We Disclose Your Information

We do not sell your data. We will never provide your data to a third party without your direct consent, unless required by law.

 

We may disclose or transfer your personal information in the following circumstances:

  • We may transfer your information to third party service providers that use best practices for data protection and cybersecurity, and whose services allow us to deliver our services to you or communicate with you. The third party service providers we currently use are Amazon Web Services (AWS), Google Workspace, Wix, and Calefy Inc.

  • We may transfer information we have about you in connection with a merger, sale, or other transaction (including transfers made as part of insolvency or bankruptcy proceedings) that would result in a change in corporate control involving all or part of our business, including for the purpose of determining whether to proceed with such a transaction.

  • We, or our third party service providers, may disclose your personal information when legally required, including to comply with a subpoena, warrant, court order or other legal requirement issued by a court, tribunal, regulator or other person with jurisdiction to compel disclosure of your personal information.

  • We may disclose your personal information if it is necessary for us to collect a debt from you or where we have reason to believe that it is relevant to the investigation or decision to investigate a breach of the laws of Canada, a province or territory of Canada, or a foreign jurisdiction, and we are legally permitted to do so.

How We Protect Your Information

We use strong technical and organizational measures to safeguard your personal information. For example, our infrastructure-as-code model is state-of-the-art, ensuring that the configuration of our infrastructure is static and locked in with secure, professionally designed parameters. We also use a “zero trust” model for access to our infrastructure. This means that access to our infrastructure is extremely limited and tightly controlled. This minimizes the attack surface available to bad actors, so that your personal information and our data remains secure.

 

We require that our third party service providers safeguard your personal information, such as by using best practices for data protection and cybersecurity. Our service providers are given the4information they need to perform their designated functions, and we never authorize them to use or disclose personal information for their own marketing or other purposes.

 

Where Your Information is Stored

Your personal information may be stored by third party service providers outside of Canada, including in the United States. In the event personal information is stored outside of Canada, it will be subject two the laws of the country in which it is used or stored.

 

Children and Minors

Our Websites are not directed to children under the age of 13, and we do not knowingly collect personal information from anyone under the age of 13. However, given the nature of the services we provide, some of the information our adult users provide when using our services may relate to children under the age of 13 (e.g., in the context of disputes over custody).

 

Links to Third-Party Websites

You may be able to access third-party websites through links available on our websites. These links are provided for your convenience and are for informational purposes only. We do not have any control over those third-party websites and we do not guarantee that the privacy practices of the operators of those websites meet our standards. Your use of such third-party websites is at your own risk and will be governed by the privacy policies of those websites and not by this Privacy Policy. We recommend that you review the privacy policies governing third-party websites before transmitting any personal information using those websites.
